Terms and Conditions for Wake N Brake Automotive & A/C Services LLC

Welcome to Wake N Brake! These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“Customer,” “you,” or “your”) and Wake N Brake (“we,” “us,” or “our”). Please read these Terms carefully before booking or using our mobile automotive air conditioning (“A/C”) repair, maintenance, or related services (“Services”). By accessing or utilizing our Services, you agree to abide by these Terms in full. If you do not agree with any part of these Terms, please do not proceed with our services.

  1. Service Description and Scope
    1.1 Service Provision: Wake N Brake provides, basic maintenance services, suspension and brake services, engine diagnostics/repair, EVAP diagnostics/repair, minor transmission diagnostics/repairs, engine and transmission replacements, electrical automotive diagnostics/repair, A/C diagnostics/repair, maintenance, leak detection, compressor repair/replacement, refriderant recovery and recycling, system cleaning, sensor and switch diagnostics, and related services at the location specified by customers/technician(s).

1.2 Service Limitations: Our technician(s) will perform only those services explicitly agreed upon at the time of booking. Any additional or unforeseen repairs will require prior authorization from the Customer and may incur extra charges.

1.3 Equipment and Parts: We utilize professional-grade tools, diagnostic equipment, and manufacturer-approved parts where applicable. Parts and materials used are subject to availability and may be substituted with equivalent components if necessary, at our discretion.

1.4 System Compatibility: The Customer acknowledges that certain vehicles or systems may have limitations or incompatibilities that could affect the outcome of repairs or maintenance.

  1. Booking, Scheduling, and Confirmation
    2.1 Booking Process: Bookings can be made by contacting us via phone, email, or other direct communication methods. We do not accept appointment requests through online booking platforms.

2.2 Confirmation and Scheduling: Once your booking request is received, we will confirm the appointment via phone, email, or SMS, including the date, time, scope of work, and estimated costs. Upon confirmation, the booking is considered binding.

2.3 Changes and Cancellations by Customer: The Customer may reschedule by providing notice at least 24 hours prior to the scheduled time. Cancellations will incur a fee of of 75 dollars. Rescheduling is subject to technician(s) availability.

2.4 Changes and Cancellations by Wake N Brake: We reserve the right to reschedule or cancel appointments due to unforeseen circumstances, weather, or safety concerns. In such cases, we will notify the Customer as soon as possible and offer alternative times or refunds.

  1. Service Fees, Estimates, and Payment Terms
    3.1 Pricing: All prices are listed in US dollars including applicable taxes, unless otherwise specified. Pricing is valid only at the time of booking and may be subject to change.

3.2 Estimates: For complex repairs, diagnostic work, or additional issues discovered during service, we may provide an initial estimate. Final charges will be based on actual work performed and parts used, and the Customer will be notified of any additional costs before proceeding.

3.3 Payment Methods: We accept [list accepted payment methods, e.g., cash, major credit/debit cards, digital wallets, bank transfers]. Payment is due upon completion of the service unless otherwise arranged.

3.4 Payment Terms and Late Payment: Payment must be made immediately upon service completion. Outstanding balances beyond 14 days may accrue late fees of 10%, and we reserve the right to suspend further services until payment is received.

3.5 Refunds: Refunds may be issued at our discretion for defective workmanship or services not performed as agreed, upon review. No refunds will be provided for work performed or parts installed if the vehicle is returned with existing issues, external damages, or tampering.

  1. Cancellations and Rescheduling Policies
    4.1 Customer-Initiated Cancellations: Must be made at least 72 hours prior to the appointment to avoid cancellation fees.

4.2 Rescheduling: Requests to reschedule must be made with sufficient notice and are subject to technician availability. Rescheduling within less than 24 hours may incur additional fees.

4.3 No-Show Policy: Failure to cancel or reschedule within the specified notice period and not providing access to the vehicle at the scheduled time may result in a no-show fee of 75 dollars.

4.4 Force Majeure: We are not liable for cancellations or delays caused by natural disasters, extreme weather, accidents, road closures, government restrictions, or other circumstances beyond our reasonable control. Fees will not be charged under these circumstances.

  1. Customer Responsibilities and Vehicle Preparation
    5.1 Access and Safety: The Customer shall ensure that the vehicle is accessible at the scheduled time and location, in a safe and operable condition (if possible), and that keys, permits, and necessary documentation are available.

5.2 Vehicle Condition: The vehicle must be in a safe, drivable state. The Customer shall remove personal belongings, loose items, or obstructions that may hinder service.

5.3 Disclosure of Vehicle and System History: The Customer shall disclose all known issues, damages, leaks, previous repairs, and modifications relevant to the A/C system and vehicle to assist our technician(s).

5.4 Vehicle Safety: The Customer shall ensure that the vehicle complies with all applicable safety standards. The Customer shall be responsible for any damages or injuries resulting from unsafe vehicle conditions.

5.5 Inspection and Testing: After service, the Customer is encouraged to inspect the vehicle and test the A/C system to confirm satisfactory operation. The Customer accepts responsibility for further issues arising from external factors or subsequent misuse.

  1. Scope of Work, Additional Repairs, and Diagnostics
    6.1 Explicit Work Scope: Our technician(s) will perform only those services explicitly agreed upon at the time of booking.

6.2 Discovery of Additional Issues: If during service, additional issues or damages are identified that require further repair, we will inform the Customer and seek prior approval before proceeding.

6.3 Diagnostic Limitations: Diagnostic services are based on available equipment and information. We do not guarantee the resolution of all issues, especially in cases of complex or hidden system failures.

6.4 Parts and Materials: Replacement parts, consumables, and fluids will be supplied as needed and billed separately unless included in a specified package. Parts are subject to availability and may be substituted with functionally equivalent components.

6.5 Repair Authorization: No repairs beyond the initial scope will be performed without prior approval from the Customer.

  1. Liability, Warranties, and Disclaimers
    7.1 Limitation of Liability: Wake N Brake shall not be liable for any damages, losses, or injuries resulting from external factors, pre-existing vehicle conditions, or external damages. Our liability is limited to the repair or replacement of parts and workmanship within the warranty period.

7.2 Workmanship Warranty: All services performed by Wake N Brake are warranted against defects in workmanship for 6 months from the date of service. This warranty covers only the work performed and does not extend to parts or damages caused by external factors.

7.3 Part and Component Warranties: Parts supplied or replaced carry the manufacturer’s warranty, which we will assist in filing claims for. Our liability for parts is limited to replacement or refund as per manufacturer policies.

7.4 No Guarantee of Success: Due to the complexity of vehicle systems, we do not guarantee the complete resolution of all issues or system failures.

7.5 No Liability for External Damage or Misuse: We are not responsible for damage caused by external influences, improper vehicle maintenance, or misuse following our service.

7.6 Indemnification: The Customer shall indemnify and hold harmless Wake N Brake from any claims, damages, or liability arising from misuse, external damage, or modifications after service.

  1. Privacy and Data Security
    8.1 Data Collection: We collect personal data necessary for service delivery, including contact details, vehicle information, and payment data.

8.2 Use of Data: Your information will be used solely for booking, communication, billing, warranty claims, and legal compliance.

8.3 Data Sharing: We do not sell or share your personal data with third parties unless required by law or with your explicit consent.

8.4 Data Security: We implement reasonable security measures to protect your data from unauthorized access, alteration, or disclosure.

8.5 Data Retention: Your personal data will be retained for as long as necessary to fulfill the purposes outlined or as required by law.

  1. Use of Service and Vehicle Safety
    9.1 Vehicle Safety Certification: The Customer confirms that the vehicle is safe to work on and that safety-related issues (e.g., leaks, corrosion, prior damage) are disclosed.

9.2 Service Limitations: Our technicians reserve the right to refuse service if they determine that the vehicle or system poses safety hazards or if the requested work exceeds their scope of expertise.

9.3 Post-Service Safety: The Customer is responsible for inspecting the vehicle after service and for ongoing maintenance to prevent future issues.

  1. Force Majeure and External Circumstances
    We shall not be held liable for delays, cancellations, or failure to perform caused by force majeure events such as natural disasters, acts of terrorism, pandemics, government restrictions, accidents, or severe weather conditions. In such cases, we will attempt to reschedule or provide refunds as appropriate.
  2. Intellectual Property Rights
    All proprietary content, trademarks, service marks, logos, and trade secrets related to Wake N Brake Automotive & AC services LLC are owned exclusively by us and protected under applicable intellectual property laws. No use or reproduction without prior written consent is permitted.
  3. Governing Law and Dispute Resolution
    12.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of Arizona.

12.2 Dispute Resolution: Any disputes arising from these Terms shall be resolved through binding arbitration, mediation, or litigation in Pima County, Arizona, as determined by us.

12.3 Jurisdiction: The courts of Pima County, Arizona shall have exclusive jurisdiction over any legal proceedings related to these Terms.

  1. Amendments and Updates
    We reserve the right to modify or amend these Terms at any time. Changes will be posted on our website it is your responsibility to check the website periodically for changes. Continued use of our services after such modifications constitutes acceptance of the updated Terms.

15.3 Waiver: Our failure to enforce any provision shall not be deemed a waiver of our rights.
